A federal judge in Minnesota has issued a significant order restricting immigration officers in the Minneapolis area from detaining or using tear gas on peaceful protesters. The ruling by U.S. District Judge Kate Menendez includes a temporary injunction limiting the circumstances under which agents can deploy chemical irritants and prohibits them from retaliating against demonstrators exercising their First Amendment rights.

The order comes amid scrutiny of Immigration and Customs Enforcement and Border Patrol actions in the Minneapolis-St. Paul region since early December. While the Trump administration stated the operations were targeting fraud, protesters have accused the agents of violating their rights and responding violently.

The ruling specifies that officers cannot detain individuals in vehicles unless there is reasonable suspicion of obstruction. Following agents at a distance does not justify a vehicle stop, and arrests must be based on probable cause. The government argued that officers acted within legal bounds to enforce immigration laws and ensure safety.

Minneapolis Mayor Jacob Frey criticized the surge of federal agents, calling it chaotic. Governor Tim Walz and others labeled it a campaign of organized brutality. Tensions escalated when an ICE agent shot and killed a U.S. citizen, prompting demands for accountability and an end to the violent tactics.

The ACLU filed a lawsuit accusing federal immigration officers of racial profiling and unlawful detentions in Minnesota. The suit alleges violations of constitutional rights and violence against citizens based on race and ethnicity. The use of forceful crowd control tactics, including tear gas, has been documented.

Federal agents have reportedly referenced the shooting victim’s death to intimidate protesters in Minnesota. The Intercept highlighted instances where agents alluded to deadly force to deter demonstrations.
